L’Autorità Garante della Concorrenza e del Mercato (AGCM) ha pubblicato, in data 12 dicembre 2016, il parere rivolto al Presidente della Regione Lazio (AS1321).
Il parere è stato formulato ai sensi dell’art. 22 L. n. 287/90, relativamente allo stato in cui versa la gestione dei servizi di trasporto pubblico locale lungo le linee ferroviarie c.d. “ex-concesse”, ovvero le linee Roma-Ostia, Roma-Viterbo, Roma-Giardinetti, come affidati da parte della Regione Lazio alla società ATAC S.p.A., ai sensi del contratto di servizio stipulato con la società Met.Ro. S.p.A.
Tale contratto, rileva l’Autorità, prevedeva la definizione di livelli quantitativi e qualitativi dei servizi sopra elencati – tuttavia, non sono mai stati costituiti gli organi preposti alla valutazione degli aspetti qualitativi, mentre, per quanto riguarda quelli quantitativi, risulta che l’offerta di ATAC ha condotto ad una situazione di disagio per l’utenza. I dati raccolti, infatti, dimostrano come vi sia un sistematico scostamento tra la quantità dei servizi offerti e quelli invece programmati (corse soppresse, percorsi non effettuati). L’Autorità rileva anche, sulla base alle informazioni disponibili, che tali deficienze siano ascrivibili a mancanza di personale o materiali, o riconducibili a competenze di programmazione e organizzazione proprie di ATAC.
L’Autorità rileva inoltre che, nonostante la previsione nel contatto di poteri di intervento e sanzione in capo alla Regione, quest’ultima non sia mai intervenuta, continuando invece a rinnovare annualmente il detto contratto, senza nemmeno revisionare i livelli dei servizi o predisporre modalità di disciplina migliorativa degli stessi.
L’AGCM sottolinea quindi che, se è vero che la normativa vigente (art. 5, par. 6, Regolamento CE 1370/2007) consente alle regioni di affidare servizi ferroviari senza ricorso a procedure competitive, viene comunque richiesto uno sforzo motivazionale e di trasparenza a carico dell’amministrazione procedente, finalizzato a dimostrare che l’affidamento diretto risponda a criteri di efficienza.
Tanto premesso, e stante l’evidenza dell’opportunità di garantire una gestione adeguata (qualitativamente e quantitativamente) alle esigenze degli utenti dei servizi in oggetto, l’Autorità ribadisce come una procedura competitiva rappresenti la soluzione più appropriata per la selezione di uno o più gestori efficienti dei servizi, in caso contrario correndo invece il rischio di non cogliere opportunamente le occasioni di sviluppo dei servizi ottenibili da un effettivo confronto di mercato.
