La Autoridad Catalana de la Competencia (ACCO) ha publicado su Estudio “Sistemas de pago”.
El estudio analiza los sistemas de pago, puesto que son una pieza clave para competir en el mercado de los servicios financieros y, por este motivo es crucial que su regulación contribuya a incrementar el grado de competencia existente en el sector financiero.
La aprobación de la Directiva (UE) 2015/2366, del Parlamento Europeo y del Consejo, de 25 de noviembre de 2015, sobre servicios de pago en el mercado interior (en adelante, PSD2 por sus siglas en inglés), en tanto que da entrada a nuevos operadores y, por tanto, a nuevos modelos de negocio, ha introducido presiones competitivas en el sector de los servicios de pago. La regulación existente en España impone considerables costes y retrasos a la innovación, proporcionando solidas protecciones a los intermediarios financieros tradicionales, manteniendo a los nuevos operadores FinTech y startups fuera de esos mercados que requieren licencias y autorizaciones gubernamentales antes de prestar servicios financieros a clientes.
La ACCO ha identificado los aspectos que considera que son susceptibles de mejora, consistentes principalmente en:
• Una modificación de la Ley 41/1999, para incorporar a las entidades proveedoras de servicios de pago como un posible participante de los sistemas de pago.
• Dar acceso, a las entidades proveedoras de servicios de pago, a las infraestructuras técnicas de los sistemas de pago, por lo menos, en el ámbito de los pagos inmediatos en euros, (i) fijando a Iberpay, el único “operador” en el ámbito de los sistemas de pago españoles, la obligación de facilitar un servicio mayorista alternativo de acceso a estos sistemas de pago, y; (ii) posibilitando la apertura de una cuenta de efectivo en el Banco de España a las entidades proveedoras de servicios de pago para que puedan reducir su dependencia de las entidades de crédito. Ambas medidas les permitiría procesar pagos y ofrecer nuevos servicios bancarios transaccionales competitivos de manera más económica, eficaz y rápida.
• Es necesario que las normas técnicas de regulación exijan a los proveedores de servicios de pago que ofrezcan servicios de iniciación de pagos y servicios de información de cuenta, requerimientos y métodos de acceso a la información iguales a los utilizados por las propias entidades financieras, sin reducir, en ningún momento, los derechos de los consumidores y empresas. En este sentido, se insta a los responsables políticos a alinear estas normas con la PSD2, para que no excluyan tecnologías específicas y se preserve la neutralidad tecnológica en el espacio de pagos, fijando los estándares técnicos necesarios para las interfaces de comunicación entre estos nuevos operadores y los bancos.
• Con este nuevo ecosistema financiero, la ACCO valora positivamente la creación de un Regulatory Sandbox, provisto de una unidad de asesoramiento en el Banco de España y la Comisión Nacional del Mercado de Valores, compuesta por técnicos especialistas, centrada en ayudar las empresas a comprender las implicaciones regulatorias de cada una de ellas.
• No descuidar aquellas nuevas tecnologías que tienen el potencial de impulsar la simplicidad y la eficiencia, mediante el establecimiento de nuevas infraestructuras y procesos, en los servicios financieros, como lo es la tecnología Blockchain, que de forma muy simplificada, aportaría beneficios como permitir a dos usuarios realizar transacciones sin intermediación; reducir los costes de las transacciones y el riesgo de fraude online; simplificar la operatividad; incrementar la velocidad de las transacciones y permitiría ampliar el alcance y accesos a los servicios financieros en todo el mundo.
En este sentido, la ACCO propone trabajar para hacer posible nuevos modelos de negocio a través de propiciar un entorno de mercado que posibilite su desarrollo, de manera que las restricciones a la competencia, entendidas como barreras a la entrada o requisitos para el ejercicio de la actividad por parte de los nuevos oferentes, que se impongan sean únicamente las necesarias y proporcionadas y se contribuya a hacer posible esta realidad a la hora de transponer la PSD2 al marco legislativo español.
