Avec le rapport annuel sur la politique de concurrence, la Commission UE fournit aux autres institutions européennes une illustration des plus importantes initiatives législatives et de politique de concurrence entreprises au cours de l’année précédente.
L’année 2013 a connu d’importants développements concernant les politiques de concurrence, dont le rapport annuel rend compte. En particulier :
– l’adoption d’une proposition de directive du Parlement européen et du Conseil relative à certaines règles régissant les actions en dommages et intérêts en droit interne pour les infractions aux dispositions du droit de la concurrence des États membres et de l’Union européenne, qui a été récemment approuvée par le Parlement européen ;
– l’initiative relative à la modernisation de la politique de l’UE en matière d’aides d’État ;
– l’adoption d’une Communication concernant l’application, à partir du 1er août, des règles en matière d’aides d’État aux aides accordées aux banques dans le contexte de la crise financière ;
– l’adoption d’une un ensemble de mesures visant à simplifier le contrôle des concentrations.
En outre, dans son rapport annuel, la Commission rappelle certaines de ses décisions les plus importantes adoptées en matière de concurrence :
– en ce qui concerne les ententes mises en oeuvre en violation de l’article 101 TFUE, la Commission se réfère en particulier aux décisions concernant le cartel entre les producteurs de faisceaux de fils électriques pour les voitures, les produits pharmaceutiques (Johnson & Johnson and Novartis et Lundbeck), les produits financiers (précédé par une notification des griefs dans le cadre d’une enquête sur les contrats d’échange sur risque de crédit), la téléphonie, les services Internet (Google) et les brevets BEN (cas de Motorola et Samsung).
– Dans le secteur de l’énergie, la Commission européenne a plutôt favorisé les engagements des entreprises qui offraient une plus grande ouverture des infrastructures à la concurrence et sanctionné les aides d’État illégaux (cas de ČEZ et EPEX).
Enfin, le rapport annuel rappelle l’importance de la coopération internationale entre les autorités de la concurrence afin de promouvoir la convergence des règles de concurrence.
